New York State has implemented its most significant income tax changes in years for the 2026 tax year. The middle-class rate cuts enacted in the FY 2026 state budget (Chapter 59 of the Laws of 2025, Part A) lower most rates, while the top three brackets above $1,077,550 are now flat-rate bands. On the federal side, the One Big Beautiful Bill Act (OBBB) takes full effect for 2026, raising the standard deduction and lowering most marginal rates.

New York State Tax Brackets for 2026

New York maintains a nine-bracket structure for individual filers. For 2026, the first five rates drop from 4.0%-6.0% to 3.9%-5.9%, and the top three bands become flat rates — above $1,077,550, ALL of your taxable income is taxed at the single rate shown. Flat bands are different. In the lower brackets only the income within each band is taxed at that rate. Once taxable income exceeds $1,077,550, the entire amount is taxed at 10.45% (and at 11.10% or 11.70% above $5 million / $25 million).

Standard Deduction Updates

For 2026, the New York State standard deductions are:

  • Single filers: $8,000
  • Married filing jointly: $16,050
  • Head of household: $11,200
  • Married filing separately: $8,000
  • At the federal level, the OBBB increase brings the 2026 standard deduction to $16,100 for single filers, $32,200 for married filing jointly, and $24,150 for head of household (IRS Rev. Proc. 2025-32).

    NYC Resident Tax

    If you live in New York City, you'll continue to pay the NYC resident income tax in addition to state taxes. NYC tax rates for 2026 remain unchanged at 3.078% to 3.876%, depending on your income level.

    Empire State Child Credit

    The expanded Empire State Child Credit is now the most valuable credit for NY families: up to $1,000 per child under age 4 and up to $330 per child ages 4-16 for tax year 2025 returns (filed in 2026). The credit is now fully refundable, and the phaseout starts at higher incomes — the full credit remains available to married couples filing jointly earning up to $110,000.
